Elements Of A Personal Injury Claim

Personal injury claims arise anytime the careless, negligent, or intentional actions of another individual, entity, or business cause harm to another. The injured individual will typically have the option to file an insurance claim or file a civil personal injury lawsuit against the other party. In these situations, there will normally be four elements of negligence that must be in place in order for the case to move forward successfully:

Duty of Care: A duty of care will look different depending on the type of injury claim we are discussing. For example, different duties of care exist in various areas. For example, every driver on the roadway owes a duty of care to others. Simply by having a license and operating a vehicle, drivers are required to operate safely. Owners of stores have a separate type of duty of care, namely to ensure their premises are safe for those who have a right to be there. Doctors owe a different type of duty of care altogether to their patients. There must be a duty of care established between the plaintiff and the defendant.

Breach of Duty: After a duty of care has been established, it must be shown that the defendant somehow breached their duty to the plaintiff. Again, this breach of duty will look different depending on the type of claim at hand. For example, a driver can breach their duty of care if they operate their vehicle while distracted by their cell phone. Store owners can breach their duty of care if they fail to clean up a spill that they knew about. Doctors can breach their duty of care if they fail to obtain patient consent for a procedure.

Causation: The next step after establishing that a breach of duty occurred is showing that the breach directly or indirectly caused the injuries to the plaintiff.

Damages: Finally, it must be shown that the plaintiff sustained some sort of monetary loss as a result of the breach of duty and their injuries. This can include medical bills, lost wages, and pain and suffering damages.

Philadelphia Personal Injury Cases We Handle

Philadelphia personal injury lawyer

Our attorneys handle a wide range of types of injuries from vehicle accidents to those needing the assistance of our slip and fall attorneys in Philadelphia. Please understand that the following list is not exhaustive, and if you have been injured due to the negligence of another individual or entity, reach out to an attorney so we can discuss every aspect of your case with you:

Car Accidents:

Car accidents are one of the most common causes of personal injuries in Philadelphia. These incidents can occur in a wide variety of ways, often due to another driver’s distracted driving, impaired driving, failure to obey traffic laws, speeding, etc. Whether minor or severe, accidents can become complicated when working to recover compensation from insurance carriers.

Truck Accidents:

Accidents involving larger commercial trucks typically result in much more severe injuries and property damage than traditional vehicle crashes. Often, truck accidents are caused by the careless or negligent actions of either the truck driver or the trucking company, and these other parties must be held liable.

Motorcycle Accidents:

Motorcyclists are much more vulnerable on the roadway than traditional vehicle drivers, even if they are wearing a helmet. An impact with a much heavier motor vehicle can lead to catastrophic injuries. Motorcyclists are often ignored on the roadway by other drivers, which can lead to devastating incidents.

Bus Accidents:

Just like truck accidents, bus accidents can result in significant injuries due to the sheer size and weight of these vehicles. These injuries can occur to the passengers on the bus as well as to those in other vehicles. Our team often handles accidents involving public transport buses as well as privately owned bus lines.

Rideshare Accidents:

Rideshare services like Uber and Lyft are a very common sight throughout Philadelphia. However, recovering compensation after an accident involving a rideshare vehicle can be complicated. The insurance companies involved have complex “tiers,” which means coverage will depend on the status of the rideshare driver at the time the incident occurred.

Bicycle Accidents:

Bicyclists and pedestrians are also considered vulnerable roadway users. Any type of collision with a heavier motor vehicle is likely to lead to a severe injury for a pedestrian or bicyclist, though navigating the insurance issues after these incidents is challenging.

Dog Bite Injuries:

Dogs can inflict severe injuries with their jaws, and victims must have a way to recover compensation. Pennsylvania is a strict liability dog bite state which means that the owners and keepers of a dog will have to pay the victim’s medical costs so long as the bite occurred on public property or private property where the victim had the right to be, even if the dog owner was not negligent.

Workplace Injuries:

Individuals who sustain workplace injuries should be able to recover compensation for their losses. Almost all employees in Pennsylvania are covered through the state’s workers’ compensation system, but there are times when employers or insurance carriers deny a claim when they shouldn’t.

Negligent Security:

Negligent security can include a variety of issues, including not having physical security guards, failing to have working surveillance cameras, doors or windows that do not lock properly, and more.

Construction Accidents:

The construction industry is incredibly dangerous. Anytime a construction worker in Philadelphia sustains an injury, they should be able to recover compensation through the state’s workers’ compensation system. Additionally, there are often third parties involved at construction sites, which could open the door to third-party personal injury lawsuits to recover additional types of compensation.

Medical Malpractice:

Medical mistakes can include prescription errors, early discharge, misdiagnosis, surgical errors, anesthesia errors, and more. Anytime a medical professional fails to uphold an adequate standard of medical care, and a patient is harmed, individuals should be able to recover compensation for their losses.

Mass Tort Claims:

Anytime a negligent act or omission causes harm or injuries to numerous people, a mass tort claim could arise. Some of the most common types of mashed tort claims include groundwater contamination, pollution, commercial plane accidents, defective medication claims, etc.

This is certainly not a complete list of the types of injuries that we help clients in Philadelphia. If you or somebody you care about has been injured due to the negligent actions of another individual or entity, we encourage you to reach out to a skilled lawyer immediately so we can begin working on your claim.

Damages Available In A Philadelphia Personal Injury Case

Philadelphia personal injury attorney

There may be a wide range of types of compensation available for your Philadelphia personal injury claim. Our skilled attorneys work hard to recover both economic and non-economic losses on behalf of every client that we help.

  • Economic damages. Economic damages are also regularly referred to as “special damages.” these are the types of calculable losses that personal injury victims in Philadelphia are likely to sustain. We use the word “calculable” because personal injury victims and their attorneys will typically be able to accurately calculate these expenses because there are bills, receipts, pay stubs, and other direct solid types of evidence that give a dollar amount. Some of the most common economic damages Philadelphia personal injury victims incur include:
    • Medical expenses
    • Physical therapy and rehabilitation
    • Lost income
    • Out-of-pocket expenses
    • Property damage expenses
  • Non-economic damages. Non-economic damages are also referred to as “general damages.” These types of expenses are less calculable because there are no direct bills or receipts that we can gather and add up to reach a total. However, even though these types of damages are more intangible, they are certainly real. Some of the most common types of non-economic damages a Philadelphia personal injury victim incurs include:
    • Emotional and psychological trauma
    • Physical pain and suffering
    • Loss of enjoyment of life
    • Loss of consortium for a spouse or family members

The Four Types of Negligence in a Personal Injury Claim

There are various types of negligence that may come up when discussing a personal injury claim. These types that we want to discuss are aside from “ordinary negligence” established by showing the four elements mentioned above.

  • Gross Negligence. This type of negligence is above and beyond ordinary negligence and typically revolves around intentional actions or extremely reckless behavior on the part of the plaintiff. A person may be found grossly negligent if they knew or should have known that their actions would cause harm to another individual and continued their actions anyway.
  • Contributory Negligence. Contributory negligence is not used in many states around the country, and this refers to individuals becoming unable to recover compensation if they are in the least bit at fault for their own injuries. For example, if a person was 1% responsible for causing a slip and fall injury, and a store owner is 99% responsible for the incident, the individual would still be unable to recover compensation because they were 1% at fault.
  • Comparative Negligence. Comparative negligence laws are in place in many states around the country, including Pennsylvania. Under this system in PA, individuals can recover compensation if they are partially at fault, so long as they are not 51% or more responsible for causing their own injury. The total amount of compensation the individual receives will be reduced depending on their percentage of fault.
  • Vicarious Negligence. Vicarious negligence deals with another individual or entity being indirectly responsible for an incident. For example, if a store employee causes harm to a patron, the store will likely be held responsible for the injuries if the employee was carrying out job related duties when the injury occurred.

What is the Statute of Limitations in Philadelphia?

Personal injury victims in Philadelphia have a limited amount of time to file lawsuits against the other party. The personal injury statute of limitations in Pennsylvania is two years from the date an injury occurs. Failing to file a civil lawsuit against the alleged negligent party within this time frame will likely leave the victim unable to recover compensation for their losses.

There are various exceptions to this statute of limitations, including situations where the injured individual is under the age of 18 and situations where the defendant leaves the state of Pennsylvania for more than four months or conceals themselves within the state. We encourage you to speak to your personal injury attorney in Philadelphia about any exceptions that may apply to your particular situation.

Factors That Influence a Personal Injury Claim’s Worth

There are various factors that can influence how much a personal injury claim is worth. No two injuries are exactly alike, and some of the factors that an insurance carrier or personal injury jury will examine when trying to compensate injury victims include the following:

  • The severity of the injury
  • The length of the recovery time
  • Whether or not any individual can work
  • The injury victim’s life expectancy, education level, and occupation
  • The level of any property damage
  • Whether or not there was any shared fault for the incident
  • The level of any disability or scarring and disfigurement
  • How much pain and suffering can be shown

When working to adequately calculate total compensation amounts after an injury occurs in Philadelphia, a skilled attorney will work with trusted medical and financial experts. These individuals will examine every aspect of the claim and how the incident has affected the victim’s life. It may be necessary for expert witnesses to testify in front of a jury, and these witnesses can help influence the total amount of compensation a person receives upward or downward, depending on whether or not the witness is for the plaintiff or defendant.
