A jury or judge can simply assume the facts based on the evidence presented.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">If <\/span><i><span style=\"font-weight: 400;\">res ispa loquitur <\/span><\/i><span style=\"font-weight: 400;\">is used in a case, the onus is on the defendant (the person alleged to have caused the injury) to provide evidence that they were not negligent.
