As the rhetoric is ratcheted up,\u00a0 many Philadelphia voters worry for their overall safety. Voter intimidation, or any threatening behavior at polls for that matter, is illegal by federal law and by Pennsylvania law, punishable by imprisonment. But the lines can get quickly blurred when the Election Code does not address firearms directly, and no current law restricts carrying guns into polling places unless they are located at a school or court facility (<\/span><a href=\"https:\/\/casetext.com\/statute\/pennsylvania-statutes\/consolidated-statutes\/title-18-pacs-crimes-and-offenses\/part-i-preliminary-provisions\/chapter-9-inchoate-crimes\/section-912-possession-of-weapon-on-school-property\"><span style=\"font-weight: 400;\">18 Pa. C.S. \u00a7 912<\/span><\/a><span style=\"font-weight: 400;\">). In fact, Pennsylvania\u2019s statute limits the country from regulating firearms, if the possession and use is lawful (<\/span><span style=\"font-weight: 400;\">18 Pa.C.S. 6120<\/span><span style=\"font-weight: 400;\">).\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">That said, Philadelphia\u2019s response to voter intimidation and Pennsylvania\u2019s guidelines concerning poll watchers, for the most part, are clear and unyielding. Just this month, Philadelphia\u2019s judge ruled against the Trump campaign\u2019s attempt to have unauthorized poll watchers at satellite election offices, and Philadelphia\u2019s DA created an Election Task Force with a hotline specifically to address voter intimidation and any potential threat at election polls.\u00a0<\/span><\/p>\n<p><img decoding=\"async\" class=\"size-full wp-image-42326 aligncenter\" src=\"https:\/\/ciccarelli.com\/philadelphia-injury-lawyers\/wp-content\/uploads\/2020\/10\/PA-polling-laws.jpg\" alt=\"Pennsylvania Polling Place Laws\" width=\"100%\" srcset=\"https:\/\/ciccarelli.com\/philadelphia-injury-lawyers\/wp-content\/uploads\/2020\/10\/PA-polling-laws.jpg 900w, https:\/\/ciccarelli.com\/philadelphia-injury-lawyers\/wp-content\/uploads\/2020\/10\/PA-polling-laws-300x100.jpg 300w, https:\/\/ciccarelli.com\/philadelphia-injury-lawyers\/wp-content\/uploads\/2020\/10\/PA-polling-laws-768x256.jpg 768w\" sizes=\"(max-width: 900px) 100vw, 900px\" \/><\/p>\n<h2><b>What are Philadelphia\u2019s Laws for Poll Watchers?\u00a0<\/b><\/h2>\n<p><b>To become an authorized poll watcher (<\/b><a href=\"https:\/\/www.dos.pa.gov\/VotingElections\/OtherServicesEvents\/Documents\/DOS%20GUIDANCE%20ON%20RULES%20IN%20EFFECT%20AT%20THE%20POLLING%20PLACE%20ON%20ELECTION%20DAY%2010-16.pdf\"><b>25. P.S. \u00a72687<\/b><\/a><b>):<\/b><span style=\"font-weight: 400;\"> You must be a qualified registered elector of the county you are looking to poll watch. Poll watchers must be assigned to specific precincts, receive official county credentials ahead of time, and identify themselves. As a poll watcher, you are required to have a certificate from the County Board of Elections with your name and the name of the candidate or political party you represent. Each party may appoint up to three poll watchers per precinct and each candidate may appoint two watchers per precinct.\u00a0<\/span><\/p>\n<p><b>Note: <\/b><span style=\"font-weight: 400;\">Per the Election Code (<\/span><a href=\"https:\/\/www.dos.pa.gov\/VotingElections\/OtherServicesEvents\/Documents\/DOS%20GUIDANCE%20ON%20RULES%20IN%20EFFECT%20AT%20THE%20POLLING%20PLACE%20ON%20ELECTION%20DAY%2010-16.pdf\"><span style=\"font-weight: 400;\">25 P.S. \u00a7 3060<\/span><\/a><span style=\"font-weight: 400;\">), campaigning is not permitted at the polling place. Local election officers, poll workers, and poll watchers are prohibited from wearing partisan attire or carrying other campaigning material.\u00a0<\/span><\/p>\n<h2><b>What Exactly is Considered \u201cVoter Intimidation?\u201d<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Voter intimidation is any activity or behavior that interferes with the voter\u2019s right to vote, and it is important to note that this includes activity that happens inside or outside of the polling place and the time frame of Election Day. Voter intimidation is illegal and can involve harassing, threatening, or coercive acts.\u00a0<\/span><\/p>\n<h3><b>Voter Intimidation Statute:<\/b><span style=\"font-weight: 400;\">\u00a0<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">In Pennsylvania, the statute is \u201c<\/span><a href=\"https:\/\/www.attorneygeneral.gov\/wp-content\/uploads\/2020\/10\/PDAAElectionGuidance.pdf\"><span style=\"font-weight: 400;\">25 P.S. \u00a7 3547<\/span><\/a><span style=\"font-weight: 400;\">: Prohibiting Duress and Intimidation of Voters and Interference with the Free Exercise of the Elective Franchise.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Voter intimidation can include:\u00a0<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Taking pictures or recording videos of voters\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Spreading misleading or false election information to voters<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Blocking the entrance to a polling place\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Behaving in a way that comes off as threatening\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Not maintaining a respectful distance from voters and confronting, directly speaking to, or questioning voters<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Asking voters for documentation\u00a0<\/span><\/li>\n<\/ul>\n<h2><b>Penalties for Voter Intimidation:\u00a0<\/b><\/h2>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">By law (<\/span><a href=\"https:\/\/dos.pa.gov\/VotingElections\/OtherServicesEvents\/Documents\/DOS%20Voter%20Intimidation%20Guidance%2010.14.16.pdf\"><span style=\"font-weight: 400;\">52 U.S.C. \u00a7 10308<\/span><\/a><span style=\"font-weight: 400;\">): Discriminating against voters can result in a fine up to $5,000 and up to five years in prison.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">(<\/span><a href=\"https:\/\/dos.pa.gov\/VotingElections\/OtherServicesEvents\/Documents\/DOS%20Voter%20Intimidation%20Guidance%2010.14.16.pdf\"><span style=\"font-weight: 400;\">52 U.S.C. \u00a7 241<\/span><\/a><span style=\"font-weight: 400;\">): Conspiring to interfere with a person\u2019s right to vote can result in up to 10 years in prison.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">(<\/span><a href=\"https:\/\/dos.pa.gov\/VotingElections\/OtherServicesEvents\/Documents\/DOS%20Voter%20Intimidation%20Guidance%2010.14.16.pdf\"><span style=\"font-weight: 400;\">25 P.S. \u00a7 3547<\/span><\/a><span style=\"font-weight: 400;\">): Intimidating voters can result in a fine up to $5,000 and up to two years in prison.\u00a0<\/span><\/li>\n<\/ul>\n<h2><b>Policy on Masks during COVID-19:<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">In Philadelphia, the Department of Health\u2019s <\/span><a href=\"https:\/\/www.governor.pa.gov\/wp-content\/uploads\/2020\/07\/20200701-SOH-Universal-Face-Coverings-Order.pdf\"><span style=\"font-weight: 400;\">Universal Face Coverings Order<\/span><\/a><span style=\"font-weight: 400;\"> requires poll watchers and poll workers to wear masks at all times. Election polls will maintain a supply of gloves, masks and hand sanitizer, offering masks to voters without one. Voters, however, are strongly advised to wear masks, but will be permitted to vote either way.<\/span><\/p>\n<h2><b>How to Stay Safe:<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">If you experience voter intimidation, or something that just doesn\u2019t feel right, contact the Philadelphia DA\u2019s Election Task Force hotline at 215-686-9641, and the national voter hotline at 1-866-OUR-VOTE.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">You have every right to be at a polling place, to vote, and to feel completely safe.
