Let us use a three-car collision as an example.<\/p>\n<p>Suppose car \u201cA\u201d gets into a crash that is caused by cars \u201cB\u201d and \u201cC.\u201d During a trial, the jury determines that the driver of car \u201cA\u201d should be awarded $100,000 in damages. The jury also determines that car \u201cB\u201d was 90% responsible for the crash, and car \u201cC\u201d was 10% responsible for the crash. However, car \u201cB\u201d only has $15,000 in liability coverage. Under the old law in Pennsylvania, driver \u201cA\u201d would receive $15,000 from \u201cB\u201d and $85,000 from \u201cC,\u201d even though \u201cC\u201d was only 10% responsible for the crash.<\/p>\n<p>Driver \u201cA\u201d would collect the full amount of the jury verdict award.<\/p>\n<p>Under the new 2011 \u201cjoint and several liability\u201d law, any defendant in a case will only be responsible for their proportionate share of the jury verdict. Following the same example that we just used, driver \u201cA\u201d would receive $15,000 from \u201cB.\u201d While \u201cB\u201d was 90% responsible for the crash and should have to cover $90,000, their liability coverage was only for $15,000. In this case, \u201cA\u201d would also receive $10,000 from \u201cC,\u201d because they were 10% responsible.<\/p>\n<p>Driver \u201cA,\u201d under Pennsylvania law, would receive $25,000, much less than the $100,000 awarded by the jury.<\/p>\n<h2>How comparative negligence works in Pennsylvania<\/h2>\n<p>There are several other factors that go into car accidents in Pennsylvania, and you should certainly speak to an attorney when there are multiple parties involved or when liability is questioned.
