As we briefly discuss drug possession penalties, we do want to point out that the penalties for personal use will be less severe than the penalties related to the possession of a narcotic with the intention to distribute or sell it.

First, we want to look at marijuana drug possession laws in Arizona. In this state, it is illegal to possess marijuana (except for those approved for medical marijuana possession and consumption). If we look at Arizona Proposition 207, we can see that this state has taken a more lenient approach to those caught in possession of marijuana.

In general, non-violent first- and second-time marijuana possession offenders will not face time in jail. These individuals will be able to participate in education or diversion programs in lieu of incarceration time.

  • 9 grams of methamphetamine
  • 9 powdered grams of cocaine
  • 3/4 gram in rock form of crack cocaine
  • 1/2 milliliter of LSD or 50 dosage units of blotter form of LSD
  • 4 grams or 50 milliliters of PCP
  • If a person is found in possession of narcotics in amounts at or above these thresholds, they will face charges related to possession with intent to distribute.

Possession of Drugs for Sale/Transportation for Sale is a class two felony under Arizona law and can carry the following penalties:

  • A penalty of probation to one year of incarceration for a first offense if under the threshold;
  • Two Hundred and Forty hours of community service if placed on probation;
  • Three (3) years to 12.5 Twelve- and one-half years if above the threshold;
  • 4.5 Four and one half to 23.25 of “prison only” for individuals with one allegeable historical prior felony conviction; and
  • 10.5 years to 35 years of prison for two (2) allegeable historical prior felony convictions.

For narcotics not on this list, the threshold will be any amount of the drug that is valued at $1,000 or more.
